«Аргумент о том, что подобное общее планирование не может существовать в условиях полной диктатуры, несостоятелен. План, в осуществлении которого участвует ряд лиц, все равно остается планом, даже если он задуман лишь одним из них; и те, кто исполняет план, не избегают ответственности, доказывая, что они действовали под руководством человека, который его задумал» [681]

Данное положение опровергает дальнейший довод о том, что лицо, связанное с исполнением такого гитлеровского плана, не может быть виновным в сговоре или подлежать наказанию за содействие в осуществлении этого плана или замысла в качестве соучастника сговора. Несомненно, верно, что не все подсудимые принимали участие в разработке плана, замысла или сговора Министерства юстиции нацистского режима с целью выполнения декрета «Ночь и туман», однако они знали о его противоправности и бесчеловечной цели и помогали его осуществлять. Факты вне разумного сомнения доказывают, что они осознанно содействовали, помогали и были связаны с планом, замыслом или сговором в целях ведения войны и совершили те военные преступления [и преступления] против человечности, которые вменены им в вину в обвинительном заключении. Трудно было бы составить более совершенный план или замысел, свидетельствующий о сговоре с целью совершения преступлений, чем соглашение, заключенное между ОКВ, Министерством юстиции и гестапо для исполнения и реализации декрета Гитлера «Ночь и туман». Все подсудимые, которые принимали участие в исполнении и реализации декрета «Ночь и туман», знали о его незаконности и о его жестоких и бесчеловечных целях.

А. Введение

В соответствии со статьями XV и XVII Ордонанса № 7 приговоры, вынесенные трибуналом, подлежат пересмотру Военным губернатором. 18 января 1949 года генерал Люциус Д. Клей, Военный губернатор американской зоны оккупации, отдельными приказами утвердил пожизненные приговоры, вынесенные в отношении подсудимых Клемма, Эсея, Ротхауга и Шлегельбергера, а также приговоры к тюремному заключению на определенный срок, вынесенные в отношении подсудимых Альтстёттера, фон Аммона, Йоэля, Лаутца, Метгенберга и Ротенбергера. Приказ, утверждающий пожизненный приговор в отношении подсудимого Шлегельбергера, воспроизводится ниже.

Приказ в отношении приговора Франца Шлегельбергера

По делу Соединенных Штатов Америки против Йозефа Альтстёттера и др., рассмотренному Военным трибуналом III США (Дело № 3, Нюрнберг, Германия), подсудимый Франц Шлегельбергер 4 декабря 1947 года был приговорен Трибуналом к пожизненному заключению. Ходатайство об изменении приговора, поданное от имени подсудимого его адвокатом д-ром Эгоном Кубушком, было передано мне в соответствии с положениями Ордонанса Военного правительства № 7. Я надлежащим образом рассмотрел ходатайство и материалы судебного процесса и в соответствии со статьей XVII упомянутого Ордонанса настоящим постановил:

a. Приговор, вынесенный Военным трибуналом III в отношении Франца Шлегельбергера, настоящим утверждается во всех отношениях.

b. Подсудимый должен содержаться в тюрьме для военных преступников № 1 в Ландсберге, Бавария, Германия.
