«Если судно совершило правонарушение, выйдя в плавание с намерением войти в блокированный порт или выйдя из него, правонарушение не смывается до окончания рейса; до завершения этого периода любые крейсеры правомочны задержать его и возбудить против него производство за это правонарушение». В этом деле довод о небрежности блокирующих сил, допускавших вход или выход судов, был признан состоятельным, и судно, являвшееся прусским и захваченное во время рейса из Руана в Альтону, в отношении которого велось производство за прорыв блокады Гавра, было возвращено.
