«Суверенитет моря: Исторический очерк притязаний Англии на господство в британских морях»

Ст. 4. — В случае войны нейтральное прибрежное государство имеет право установить своей декларацией о нейтралитете или путем специального уведомления свою нейтральную зону за пределами шести миль вплоть до дальности береговой артиллерии.

Ст. 5. — Все суда без исключения имеют право мирного прохода через территориальное море, за исключением права воюющих сторон регулировать и в целях обороны перекрывать проход в упомянутом море для любого судна, а также за исключением права нейтральных государств регулировать проход в упомянутом море для военных судов любых национаществ. Настоящая статья не отменяет положения статьи 10.

Ст. 6. — Преступления и проступки, совершенные на борту иностранных судов, проходящих через территориальное море, лицами, находящимися на борту этих судов, в отношении лиц или имущества на борту этих же судов, как таковые, находятся вне юрисдикции прибрежного государства, если только они не влекут за собой нарушение прав или интересов прибрежного государства либо его граждан, не входящих в состав экипажа или пассажиров.

Ст. 7. — Суда, пересекающие территориальные воды, должны соблюдать специальные правила, изданные прибрежным государством в интересах и для безопасности судоходства, а также морской полиции.

Ст. 8. — Суда всех национальностей в силу одного лишь факта их нахождения в территориальных водах, если только они находятся там исключительно проходом, подпадают под юрисдикцию прибрежного государства.

Прибрежное государство имеет право продолжать в открытом море преследование, начатое в территориальном море, задерживать и судить судно, совершившее уголовное правонарушение в пределах его вод. В случае захвата в открытом море об этом, однако, без промедления уведомляется государство, чей флаг носит судно. Преследование прерывается, как только судно входит в территориальные воды своей страны или третьей державы. Право преследования прекращается, как только судно войдет в порт своей страны или третьей державы.

Ст. 9. — Особое положение военных судов и судов, приравненных к ним, сохраняется.

Ст. 10. — Положения предыдущих статей применяются к проливам, ширина которых не превышает двенадцати миль, за исключением следующих изменений и различий:—

1 o Проливы, берега которых принадлежат разным государствам, являются частью территориального моря прибрежных государств, которые осуществляют в них свой суверенитет до срединной линии.

2 o Проливы, берега которых принадлежат одному государству и которые необходимы для морских сообщений между двумя или более государствами, отличными от прибрежного государства, всегда составляют часть территориального моря прибрежного государства, каково бы ни было сближение берегов. Они никогда не могут быть перекрыты.

3 o В проливах, берега которых принадлежат одному государству, море является территориальным, даже если расстояние между берегами превышает двенадцать миль, если у каждого входа в пролив это расстояние не превышается.

4 o Проливы, служащие проходом из одного свободного моря в другое свободное море, никогда не могут быть перекрыты.

Ст. 11. — Режим проливов, в настоящее время подчиненный специальным конвенциям или обычаям, остается в силе.
