25 ноября 1864 г., проведя почти год в южных тюремных лагерях, Смит был условно освобожден в Саванне, шт. Джорджия, и отправлен в Аннаполис, где его поместили в госпиталь, где он оставался до демобилизации. Все военнослужащие полка, захваченные в плен вместе с ним, умерли от болезней в тюрьмах мятежников.
