Первое учрежденное бюро используется до организации второго

В случае если одно из двух ведомств, упомянутых в настоящей Конвенции, будет учреждено, страны, принадлежащие к группе, отличной от той, которой соответствует данное Бюро, имеют право присоединиться к нему до учреждения второго Бюро. После учреждения второго Бюро первое Бюро препровождает последнему все данные, упомянутые в статье 12.

Статья 12

О присоединениях к договору должно сообщаться Бразилии

Что касается присоединения американских наций к настоящей Конвенции, то оно сообщается Правительству Соединенных Штатов Бразилии, которое препровождает его остальным, причем эти сообщения заменяют обмен нотами.

Бразилия уведомляет Бюро о каждом присоединении

Правительство Бразилии также уведомляет Международное бюро об этом присоединении, и это Бюро направляет вновь присоединившемуся государству полную ведомость всех зарегистрированных товарных знаков, патентов, моделей, рисунков и литературных и художественных произведений, которые на тот момент находятся под международной охраной.

В удостоверение чего уполномоченные и делегаты подписали настоящую Конвенцию и приложили печать Третьей Международной американской конференции.

Статья 1

Государства-участники признают и охраняют права на литературную и художественную собственность в соответствии с положениями настоящей конвенции.

Статья 2

Определение «литературных и художественных произведений»

В выражение «литературные и художественные произведения» входят книги, письменные произведения, брошюры всех видов, каков бы ни был предмет, которому они посвящены, и каково бы ни было количество их страниц; драматические или музыкально-драматические произведения; хореографические и музыкальные произведения с текстом или без текста; рисунки, картины, скульптуры, гравюры; фотографии; астрономические или географические глобусы; планы, эскизы или пластические произведения, относящиеся к географии, геологии или топографии, архитектуре или любой другой науке; и, наконец, все произведения, которые могут быть опубликованы любым способом печати или воспроизведения.

Статья 3

Формальности

Признание авторского права, полученного в одном государстве в соответствии с его законами, порождает свои последствия в силу самого права во всех остальных государствах без необходимости соблюдения какой-либо иной формальности при условии, что в произведении всегда имеется указание, свидетельствующее об оговорке права собственности.

Статья 4

Определение авторского права

Авторское право на литературное или художественное произведение включает для его автора или правопреемников исключительное право распоряжаться им, публиковать, уступать, переводить или разрешать его перевод и воспроизводить его в любой форме полностью или частично.

Статья 5

Признание авторства

Автор охраняемого произведения, за исключением случаев, когда доказано иное, считается лицом, чье имя или общепризнанный псевдоним указаны в нем; следовательно, иски, предъявленные таким автором или его представителем против контрафактчиков или нарушителей, принимаются судами государств-участников.

Статья 6

Авторы пользуются правами, гарантированными в стране происхождения, на аналогичный срок

Авторы или их правопреемники, являющиеся гражданами или иностранцами, проживающими в странах-участницах, пользуются в этих странах правами, предоставляемыми соответствующими законами, при условии, что эти права не превышают срок охраны, установленный в стране происхождения.

Произведения, состоящие из частей или нескольких томов

Для произведений, состоящих из нескольких томов, которые публикуются не одновременно, а также для бюллетеней, частей или периодических изданий, срок действия авторского права в отношении каждого тома, бюллетеня, части или периодического издания начинает исчисляться с соответствующей даты их публикации.

Статья 7

Страна первой публикации — страна происхождения

Страной происхождения произведения считается страна его первой публикации в Америке, а если оно было опубликовано одновременно в нескольких странах-участницах, то та, которая устанавливает наиболее короткий срок охраны.

Статья 8

Последующие издания — отсутствие авторского права

Произведение, на которое первоначально не было оформлено авторское право, не подлежит охране авторским правом в последующих изданиях.

Статья 9

Охрана переводов

Авторизованные переводы охраняются так же, как и оригинальные произведения.

Переводчики произведений, в отношении которых не существует гарантированного права собственности или гарантированное авторское право на которые могло быть прекращено, могут получить на свои переводы права собственности, изложенные в статье 3, но они не должны препятствовать публикации других переводов того же произведения.

Статья 10

Речи

Речи или выступления, произнесенные или зачитанные перед совещательными органами, судами или на публичных собраниях, могут быть напечатаны в ежедневной прессе без необходимости получения какого-либо разрешения, однако с должным учетом положений внутреннего законодательства каждой страны.

Статья 11

Статьи из газет

Литературные, научные или художественные произведения, независимо от их тематики, опубликованные в газетах или журналах в любой из стран Союза, не могут быть воспроизведены в других странах без согласия авторов. За исключением упомянутых произведений, любая статья в газете может быть перепечатана другими лицами, если это не было прямо запрещено, но в каждом случае должен быть указан источник, из которого она взята.

Газетные новости

Новости и прочие материалы, опубликованные исключительно для общей информации, не пользуются охраной в соответствии с настоящей конвенцией.

Статья 12

Фрагменты литературных или художественных произведений

Воспроизведение отрывков из литературных или художественных публикаций в целях обучения или хрестоматий не дает никаких прав собственности и, следовательно, может свободно осуществляться во всех странах-участницах.

Статья 13

Определение нарушений авторских прав

Косвенное присвоение неавторизованных частей литературного или художественного произведения, не имеющего оригинального характера, считается незаконным воспроизведением в той мере, в какой это затрагивает гражданскую ответственность.

Воспроизведение в любой форме всего произведения или его большей части, сопровождаемое примечаниями или комментариями под предлогом литературной критики, дополнения или приложения к оригинальному произведению, также считается незаконным.

Статья 14

Конфискация контрафактных копий и т. д.

Любая публикация, нарушающая авторское право, может быть конфискована в странах-участницах, в которых оригинальное произведение имело право на законную охрану, без ущерба для возмещения убытков или штрафов, которые могут быть наложены на лиц, совершивших контрафакцию, в соответствии с законами страны, в которой было совершено нарушение.

Статья 15

Осуществление надзора каждым правительством

Каждое из правительств стран-участниц сохраняет за собой право разрешать, проверять или запрещать распространение, представление или демонстрацию произведений или постановок, в отношении которых соответствующий орган может быть обязан осуществлять это право.

Статья 16

Конвенция вступает в силу через три месяца после ратификации

Настоящая конвенция вступает в силу между подписавшими ее государствами, которые ратифицируют ее, через три месяца после того, как они сообщат о своей ратификации правительству Аргентины, и остается в силе между ними до истечения года с даты, когда она может быть денонсирована. Эта денонсация направляется правительству Аргентины и не имеет силы, за исключением страны, которая ее произвела.
