То, что смертельная дуэль между самодержавием и нигилизмом в России должна привести к применению пыток при распутывании отчаянных заговоров недовольных, настолько естественно, что мы можем легко принять текущие утверждения об этом факте. Говорят, что заговорщики часто носят с собой яд, чтобы в случае ареста спасти себя от бесконечных мучений и риска быть вынужденными предать сообщников, а друзья заключенных не жалеют усилий, чтобы передать им какое-нибудь смертельное снадобье, с помощью которого они могут избежать экзекуции. Польские стремления к свободе подавляются таким же образом, и в 1890 году журналы зафиксировали случай Владислава Гисберта, ставшего безумным из-за длительного применения любимой пытки Марсильи — лишения сна.
До тех пор, пока человеческая природа сохраняет свои несовершенства, сбитое с толку нетерпение сильных будет склонно вымещать свою месть на слабых и беззащитных. Совсем недавно, в 1867 году, в Техасе, «Джефферсон Таймс» зафиксировала случай, когда под эгидой военных властей пытки были применены к двум неграм, подозреваемым в краже значительной суммы денег, которая была потеряна сборщиком налогов. Еще более недавний случай — тот, который был предметом законодательного обсуждения в Швейцарии, где, по-видимому, в кантоне Цуг по приказу суда человека, подозреваемого в краже, держали на хлебе и воде с 26 октября по 10 ноября 1869 года, чтобы вырвать признание, а когда это не удалось, его подвергли винтам для пальцев и избили розгами.
Бросая ретроспективный взгляд на эту долгую историю жестокости и несправедливости, печально наблюдать, что христианские общины, где истины Евангелия принимались с беспрекословным почтением, систематизировали применение пыток с хладнокровной свирепостью, неизвестной законодательству языческих народов, от которых они их унаследовали. Тщательные ограничения и гарантии, с помощью которых римское право стремилось защитить интересы обвиняемого, странно контрастируют с безрассудным пренебрежением ко всякому принципу справедливости, которое очерняет уголовное судопроизводство Европы с тринадцатого по девятнадцатый век. От этого не была свободна ни одна раса или религия. То, что кальвинист терпел во Фландрии, он причинял в Голландии; то, что католик насаждал в Италии, он претерпевал в Англии; и никто из них не считал, что теряет свою долю в Божественном Евангелии мира на земле и доброй воли к людям.
Тайны человеческой совести и человеческих мотивов почти непостижимы, и может показаться шокирующим утверждать, что эти столетия неприкрытого зла косвенно восходят к той религии, второй великой заповедью которой было то, что человек должен любить ближнего своего, как самого себя. И все же это было так. Первая заповедь, любить Бога всем сердцем нашим, будучи извращенной суеверием, придала странное направление учениям Христа. Веками допущения непогрешимой Церкви заставляли людей верить, что толкователь выше Писания. Каждый толкователь святого текста чувствовал в глубине души, что только он со своими единомышленниками поклоняется Богу так, как Бог желает, чтобы Ему поклонялись, и что каждый ритуал, кроме его собственного, является оскорблением Божественной природы. Вне его собственной общины не было спасения от вечной погибели, и пыл религиозного убеждения таким образом сделал преследование долгом перед Богом и человеком. Это привело инквизицию, как мы видели, к совершенствованию системы, нечестие которой было полным. Будучи таким образом рекомендованной, эта система стала неотъемлемой частью светского права, и когда возникла Реформация, привычки мышления, которые веками консолидировались, стали всеобщими. Самые смелые реформаторы, сбросившие иго Рима, как только они обрели власть, имели так же мало сомнений, как и сам Рим, в том, чтобы сделать обязательной свою интерпретацию божественной истины и применять к светским, так же как и к религиозным делам, жестокие максимы, на которых они были воспитаны.
И все же в общем просвещении, которое вызвало и сопровождало Реформацию, постепенно ушли страсти, создавшие жесткие институты Средневековья. Слабые и заблуждающиеся, какими мы являемся, и все еще далекие от идеала Спасителя, мы все же приближаемся к нему, даже если наши шаги мучительны и нерешительны. В медленной эволюции столетий только сравнивая отдаленные периоды, мы можем отметить наш прогресс; но прогресс тем не менее существует, и будущие поколения, возможно, смогут полностью освободиться от жестокого и произвольного господства суеверий и силы.
