В Англии в 1819 году прекратился суд поединком, в 1833 году — судебная очистка присягой (compurgation), а также была отменена привилегия духовного звания. К 1820 году в Англии насчитывалось 160 преступлений, караемых смертной казнью, включая кражу из жилого дома на сумму 40 шиллингов, кражу из магазина на сумму 5 шиллингов и тайную кражу чего-либо у человека из кармана или с одежды. Наказанием за государственную измену по-прежнему оставалось волочение и четвертование. Привилегией пэрии являлся иммунитет от любого наказания при первом осуждении за фелонию. С 1823 года церковные суды больше не могли рассматривать дела о лжесвидетельстве; с 1855 года — дела о диффамации, а лишь вопросы, касающиеся церкви. Судебная процедура включает большие жюри присяжных, заслушивающие доказательства, ведение стенограмм судебных заседаний судебными стенографистами, досудебное раскрытие доказательств (discovery), свидетельские показания, даваемые под присягой (depositions), и презумпцию невиновности (после судебных процессов над салемскими ведьмами в США). В судебную процедуру Соединенных Штатов был внесен ряд изменений: сторонам было разрешено давать показания, от судебных приказов-writ в исковом производстве отказались, а тюрьмы стали использоваться для исправления заключенных. Тюрьмы для должников были упразднены. Кроме того, закон стал восприниматься не как боговдохновенный вечный закон, который должны открывать судьи, а как закон, создаваемый человеком применительно к текущему моменту времени. Судьи штатов занимали должности пожизненно при условии безупречного поведения; они могли быть смещены посредством процедуры импичмента. В некоторых штатах судьи избирались.
